Obligation to Install Fire Alarms and Legal Basis
Background of Installation Obligation under the Fire Service Law
The obligation to install residential fire alarms is clearly stipulated in Article 9-2 of the Fire Service Act and Article 5-6, etc. of the Fire Service Act Enforcement Order. The revision of this law was prompted by the serious social problem of the increasing number of deaths caused by house fires. In particular, the number of deaths from fires occurring while people were sleeping was high, and the importance of early detection and evacuation became strongly recognized.
In 2004, the Fire Service Law was revised, making it mandatory to install fire extinguishers in stages. First, installation became mandatory for newly built houses on June 1, 2006. For existing houses, each municipality set its own effective date by local ordinance, and the requirement was phased in region by region (areas under the Tokyo Fire Department's jurisdiction, for instance, were required to comply starting April 1, 2010) until installation became mandatory for all houses nationwide, including existing ones, by June 1, 2011. As a result of this amendment, all residences, whether detached houses, apartment buildings, or rental houses, are required to have fire alarms.
Obligation of Installation in Rental Housing
The obligation to install fire alarms in rental housing is a point of confusion for many. Taking the Tokyo Metropolitan Fire Prevention Ordinance as an example, it stipulates that "persons concerned with the residence" must install and maintain residential fire alarms.
The phrase "persons concerned" is important, and specifically refers to the following three parties
The owner of the residence (owner), in his/her position of ownership of the property, is responsible for ensuring the safety of the building. In the case of rental housing, the owner has a duty to provide a safe living environment for the tenants, and as part of this duty, is responsible for installing a fire alarm system.
The manager (management company/real estate agency) is responsible for the day-to-day maintenance of the property, as it is entrusted by the owner to manage the property. The management company is often responsible for practical matters such as checking the operation of the fire alarms and managing when they need to be replaced.
The occupant (resident), as the actual user of the residence, is responsible for the proper use and basic maintenance of the fire alarm system. This includes routine inspections and initial response to dead batteries.
Thus, it is unique in that all three parties are legally obligated to install and maintain them. This is considered to be the purpose of ensuring more reliable safety against the serious life-threatening risk of fire by having all parties involved share responsibility.
Installation Location and Technical Standards
The installation location of residential fire alarms is also clearly defined in the Fire Service Law. The basic installation location is at the top of the stairs of the bedroom and the floor where the bedroom is located (except for the stairs on the first floor). This regulation is based on statistical data showing that many people are killed by fire while sleeping.
Other locations may be required depending on the number of floors and structure of the house. In addition, according to municipal fire prevention ordinances, installation in kitchens and other living rooms may be required in some areas, so it is important to check the local ordinances of the property location.
As for technical standards, residential fire alarms must be nationally certified products, and as of April 1, 2014, it is mandatory to "indicate that the product has passed the certification test". Previously, "NS Mark" products were also allowed to be sold until March 31, 2019, but the transition to certified products has now been completed.

If what you are hearing is a short, intermittent beep rather than a continuous alarm, and there is no smoke or burning smell, you are almost certainly dealing with a standalone unit's low-battery signal. A sensor wired into a building-wide system draws power from the central panel rather than an internal battery, so it is not physically capable of producing a "battery low" chirp. In a small building below the 500-square-meter threshold, this question does not even arise, since only standalone units are present.
The beep pattern itself varies by manufacturer and even by product line, a point confirmed directly by Hochiki, one of Japan's major alarm manufacturers, whose own customer support pages note that the sound and indicator-light pattern for a low-battery alert differ from model to model. Before calling the property manager, it is worth turning the unit over: the manufacturer name and model number are printed on the side or back of the housing. Reporting "the ceiling alarm in the bedroom, model such-and-such, installed in spring of a given year" leads to same-day action far more often than simply saying "the alarm is beeping."
One habit worth avoiding altogether: pulling the battery out and leaving it that way. That absence of paperwork is precisely why the informal practice recommended above — writing the installation date on the unit itself and recording it on a move-in checklist — carries so much practical weight for owners here: it is doing, voluntarily, the record-keeping that a statute would otherwise require.

Outdoor-type models are suitable for humid locations such as kitchens and under eaves, or for high-temperature, high-humidity environments like mist saunas and stone spas.
Heat detectors come in two types — differential and fixed-temperature — and are used selectively based on sensitivity, classified as special grade, Type 1, or Type 2.
For example, a highly sensitive detector can be configured to trigger an emergency bell or warning alarm first, while a less sensitive one subsequently activates fire doors and fire shutters.
This sensitivity-based differentiation has the advantage of facilitating smoother evacuation guidance.

Smoke Detectors
Smoke detectors sense the smoke produced in the early stages of a fire and come in three types: photoelectric spot type, photoelectric beam type, and ionization type.
Smoke detectors are highly effective at early fire detection and contribute to initial fire suppression, making them widely used.
In particular, buildings designated as "windowless floors" under the Fire Service Act, such as karaoke establishments, are required to install smoke detectors.
However, due to their more complex structure, they are often more expensive than heat detectors.
Additionally, smoke detectors cannot be used outdoors because condensation on the detection element renders them non-functional.
· Photoelectric Spot Type
Uses the diffused reflection of light to trigger the sensor inside the detector when smoke is present.
An LED inside the unit emits light continuously, and when this light hits smoke particles and scatters, the scattered light is detected by the receiver.
This is the most widely used and common type among smoke detectors, and it is installed in locations with a single heat source, such as kitchens.
· Photoelectric Beam Type
Emits an invisible beam of light between a light-emitting unit and a light-receiving unit, and triggers an alarm when smoke interrupts the beam.
Also known as the light-attenuation type, some models can be used with the two units placed up to approximately 100 meters apart.
· Ionization Type
Utilizes changes in ion current, and transmits a fire signal when the smoke concentration at the installation location reaches a set level.
It offers high sensitivity and good cost performance, making it widely used overseas.
However, since radioactive materials are used, special care is required when disposing of it in Japan.
Flame Detectors
Flame detectors sense the flames produced during a fire and come in two types: ultraviolet spot-type detectors and infrared spot-type detectors.
The flames produced during a fire contain not only visible light but also ultraviolet and infrared radiation.
Flame detectors trigger when these exceed a certain level.
Ultraviolet spot-type detectors are characterized by their fast response and wide monitoring range, but they may fail to detect flames when obstructed by furniture or other objects.
They also consume a lot of power, making batteries unsuitable for long-term use.
Flame detectors are installed in large spaces with high ceilings, such as movie theaters.

However, in the case of automatic fire alarm systems, since they are managed centrally for the entire apartment building, residents cannot individually stop the alarm even if it is a malfunction.

The Tokyo Fire Department states that building owners, managers, and occupants are all obligated to install fire alarms, and that in the case of rental housing, the parties involved should discuss and decide among themselves.
That said, in practice, the manager such as the owner typically bears the installation cost in rental housing.
This is because, in the case of new construction, fire alarm installation is mandated by local ordinance, so it is often included during construction.
For existing properties, some cases involve asking tenants to cover the cost of installation, but in most cases the manager handles it.
When installing fire alarms in a rental apartment, it is generally best to assume that the manager, such as the owner, will cover the cost.
Battery Replacement or Whole-Unit Replacement: Comparing the Actual Prices
The assumption that "just replacing the battery is the cheap option" is common, but it does not survive a look at the actual numbers.

The Japan Fire Alarm Industry Association, the trade body for domestic manufacturers, recommends replacing the entire unit rather than just the battery once it approaches the end of its service life. Its reasoning draws on a U.S. field survey of alarms that had been in service for eight to ten years: only one third were found to be working normally, one third had failed outright, and the remaining third had been removed by occupants. Can a Landlord Bill a Departing Tenant for the Fire Alarm?
